The attacks are usually grounded in Daubert and related opinions, and some are confused about what they say. And there is some sloppy use of the terms "subjective" and "objective," even among our own. DAUBERTONTHEWEB.COM has a good coverage of the faulty application of the case. In short, Daubert provides guidelines for trial courts but no checklist of qualifies evidence. The defense whining about the federal charges is similar to the complaints in another current case in which the State was able to appeal the ruling against fingerprint evidence. |

Thank you for the update Mr. Clough, I appreciate the information. I cannot believe the ruling made by the judge. We all know that the only errors in our field are made by individual examiners. I don't see how the methodology can be attacked. |

The latest is that the defendant has been indicted by a federal grand jury for carjacking causing death and causing death by using a firearm in a violent crime. The state can't proceed further or appeal under Maryland law, so the Department of Justice took him federally where they will no doubt be able to use the fingerprint evidence. |

Are there any updates to the Baltimore County ruling made by Judge Souder? She ruled that fingerprint evidence is not reliable enough to be used against a homicide defendant. |
