how far back does the state go back regarding working with 602 juveniles i have been arrested and was sent to prison about 10years ago, but my last arrest was 14 years ago | ||

I will need to get my fingerprints for an employer. They have a question that asks have you been arrested and fingerprinted. My answer is yes to that question but what I am curious about, will some agency have my fingerprints (Highway Patrol-DUI) from something that occured 28 years ago. (it ended up as a plea bargain where I paid a small fine) Thanks Albert | ||

What is or may be returned depends on many variables. In America, state and federal laws guide what can be disseminated. If you were fingerprinted in connection with arrest and conviction as an adult, that information is publicly accessible to anyone who visits the courthouse and looks it up... with or without your fingerprint card. If you lie to your employer about a prior arrest, it may be revealed in a fingerprint query IF the appropriate repository is queried. Not all offenses have typically been filed, for example, in the FBI's national fingerprint database. If you committed a minor offense in Utah, for example, under your maiden name (or under an alias) and are being fingerprinted in Alabama under a different name, the connection with the minor offense may never be made. The simple answer is that for serenity, the truth will normally set you free. Don't lie to your employer and you need not fear the truth. Juvenile records are a completely different story... and again, it all depends on applicable laws in your jurisdiction. Some are sealed and some are not. The severity of the offense can also be a condition for which juvenile offenses might be revealed. Consult a local attorney for more guidance on applicable laws in your jurisdiction. | ||
