Natalie, In most states employees of such establishments get fingerprinted by a local police agency (the cards are provided by them). Then the employer sends the cards into the state police and/or the FBI for a criminal records search. What is sent back to the employer is dependent on what the search is for (for example: a background check for a teacher may or may not include driving offenses). When you get a license to open a child care center your state will tell you what's required for your local area. Michele |

Recommend you contact an attorney in your local jurisdiction. The laws and agency rules/policies governing retention and use of various categories of fingerprint cards vary greatly by jurisdiction. Juvenile fingerprint records, never-charged suspects, elimination prints, and copies of fingerprint cards requested from other jurisdictions are just a few of the many categories involved. The procedures for checking to see if your fingerprints are on file also vary greatly, and sometimes require that you submit a set of your fingerprints for searching to see if any other sets are on file (under your true/claimed name or under any aliases). |

Does anyone have any incite on the legality of using victim/witness elimination fingerprint cards in cases separate from the case where the elimination prints were obtained? Also, for those who keep a file of elimination fp cards....Is there a timetable that you follow before these cards are destroyed? |
