I am fairly certain that the answer to your question is "until the submitting agency deletes them". There is no "statute of limitations" on some crimes, and those are mostly the crimes in which latent prints are registered to the IAFIS ULF. However, it is up to the agency to define what type of crime the latent print is associated with and therefore the length of time it is to be registered to the ULF. Agencies are supposed to keep the ULF up-to-date, deleting solved latents or latents in cases that have otherwise been closed. They are only supposed to keep latent prints that are truly "unsolved" (in an open case that could be prosecuted). The FBI can't be responsible for maintaining the ULF... they give this capability to the external agencies, and simply provide the IAFIS as a service for use in this way. In the future, there may need to be more enforcement of this concept, as I have personal knowledge that there are literally hundreds of latent prints in the ULF that HAVE been solved (simply not deleted) and I'm sure there are many more for which the statute of limitations have run out.

How long are latent prints kept on file in the IAFIS?

In response to Joseph's question, I believe that Civil prints are only checked against the Criminal files during their initial search. Unless they have changed it recently, it is not a two way check.

Civilian prints to my knowledge are not currently kept online and searched via IAFIS. The FBI was hoping to add this function, but being an IT professional with knowledge of the hardware needed, it would certainly require a significant amount of online storage and additional servers. Not to mention the database maintenance and initial expense of scanning the paper cards from storage.

Of course, this last part could be put off and just add new entries, but it still takes the funding for the new hardware and ongoing added support costs.

Are Civil and Criminal cards entered into AFIS in the same location. In other words if a latent is sent in, would it automatically be searched through both civil and criminal in AFIS, or are civl and criminal cards seen in AFIS as the same?

Would like to make an addition to the last posters question:

Is applicant’s 'personal identifiable information' (such as SSNs and DOBs) on civil fingerprint submissions subject to Retention and Re-disclosure after the initial fingerprint search result? In other words, are new arrested offender's fingerprints being searched against Civil fingerprints in the IAFIS or State AFIS systems to retrieve their 'personal identifiable information', including SSNs and DOBs???

Ron alludes to an important point. The FBI receives fingerprints from state agencies, and state agencies receive them from local agencies. The requirements for forwarding prints to a higher jurisdiction are varied, so there's always a possibility that a local set of prints might make its way up to the FBI IAFIS database. Best to check...

Assuming that a FOIA shows that your prints are not onfile with the FBI, you might have your prints onfile with the NYPD AFIS.

I am not sure that they would have forwarded all prints, especially if no charges, but they might have retained prints such as yours from a normal arrest.

The best way to determine if your arrest fingerprint card is on file at the FBI, is to check for yourself. FBI Fingerprint Freedom of Information Act guidelines for their Fingerprint Identification Records System are online at www.fbi.gov

The online guidance includes the following:
The subject of a record in the system may obtain a copy thereof by making a request in writing with the envelope and the letter clearly marked "Privacy Act Request." The request must include the requester's full name, date of birth and place of birth, a certified check or money order in the amount of $18 made payable to the Treasurer of the United States, and a set of rolled-inked fingerprint impressions placed upon fingerprint cards or forms commonly utilized for applicant or law enforcement purposes by law enforcement agencies. The requester must also provide a return address for transmitting the information. Such requests for access to information must be addressed to...

about a year ago I had my one and only arrest,it was over a stupid bar fight I was 22 at the time Living in NYC no charges were brought however.
giving the above scenario Would my prints be in the FBI system?

Criminal arrest fingerprint card submission and retention procedures are relatively complicated when you are asking about procedures for the entire country.

An explanation of the FBI's national fingerprint repository (IAFIS) is online at www.fbi.gov. Also, there is a phone number for you to call regarding questions about IAFIS processing: (304) 625-5590. You may want to call that number and inquire about procedures for your state (juvenile fingerprint card submission rules for felony offense arrests, etc.).

hello everyone
I'd like to know the answer to this question.I've been getting conflicting replies so i decided to ask the experts
if someone was printed for any reason (even if no charges were brought) would the prints then be automatically added to the FBI AFIS database?
